knightdale — A Durham man was charged with 11 counts of criminal activity, three of which were the result of outstanding warrants, on Sunday, Dec. 21.Interim Police Chief David Simmons said Tracy Toomer, 46, of 2617 Owen St., Durham, was traveling west on Knightdale Boulevard near the intersection of Old Knight Road when Officer Matt Kempinski clocked him on his radar at a speed of 64 in a 45 mph zone. According to the police report, Toomer actually slowed and stopped his vehicle until Kempinski began to exit his patrol car, at which time Toomer put the vehicle in drive and began to pull away.
As Kempinski followed Toomer, who proceeded west on Knightdale Boulevard toward I-540, he noted Toomer seemed to be impaired, because the vehicle was weaving erratically according to the report. Toomer ran a stop light before exiting onto I-540 north. Out of Knightdale’s jurisdiction, the Wake County Sheriff's Office took over the pursuit. After officers placed stopsticks in the road, Toomer’s vehicle ended up with one flat tire.
Shortly after, the North Carolina State Highway Patrol took over the pursuit, and at that point Toomer’s vehicle struck a patrol car.The highway patrol was able to bring Toomer to a halt near the Leesville Road exit on I-540.Toomer was charged with shoplifting and concealment of goods, simple possession of narcotics and breaking and entering by the Wake County Sheriff's Department. He was charged with a felony of speeding to elude and misdemeanors of red light violation, failure to heed to lights and siren, speeding greater than 15 mph over the speed limit, driving while intoxicated, driving while a license was revoked and driving with an open container after the consumption of alcohol by the Knightdale Police Department. Toomer was also charged by the North Carolina State Highway Patrol for assault on an officer with a deadly weapon, another felony. After officers finally stopped Toomer, his custody was turned back over to Kempinski, who took him to Raleigh to proceed with criminal charges. He was placed under a $56,000 bond, which was met, and he was released the same night. Officers said there was a strong odor of marijuana inside a cooler in Toomer’s vehicle, but their search turned up empty.
